Right of Withdrawal
Definition
Consumer: Any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial of self-employed professional activities.
A consumer is entitled to withdraw from any contract on the following conditions.
Right of withdrawal
You have the right to withdraw from this contract with fourteen (14) days without giving any reason.
The cancellation period is fourteen (14) days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise your right of withdrawal, you must inform us (Nightside Records e.U., Praterstr. 22/1/26, 1020, Vienna, Austria, E-Mail: info@nightside.at) a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form for this, but this is not mandatory.
To meet the cancellation deadline, it is sufficient to send your communication regarding your exercise of the right to withdraw before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and not later than fourteen (14) days after the day on which we are informed about your decision to withdraw from this contract.
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen (14) days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Reasons for exclusions or expiry
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
The right of withdrawal does not apply to contracts for the delivery of newspapers, periodicals or magazines with the exception of subscription contracts.
The right of withdrawal ceases to be available in the case of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.
The right of withdrawal ceases to be available in the case of sound or video recordings or computer software in a sealed package if the seal has been broken after delivery.
